Workers Compensation Attorney Winnetka
The neighborhood of Winnetka in the city of Los Angeles started out as a small farming community in 1922. Since then the population has grown to over 50,000 residents of diverse backgrounds with the majority of people being Latino, white or Asian.
Over one-fifth of those living in Winnetka have earned a four-year degree. Many of those living in the community work for the education system, for the city council, and for the police department. In all of these occupations there is the potential to suffer personal injury while at work.
What to Do If You Are Injured on the Job
If you are injured while at work, you have the right to file a worker’s compensation claim. By filing a claim you may receive compensation for:
- Medical bills
- Wage loss
- Transportation to and from medical appointments
You may also receive payment for permanent disability or supplemental job displacement benefits.
How Are Worker’s Compensation Payments Calculated?
Medical treatment
Seek medical treatment as soon as possible. Regardless of whether your employer’s insurance company rejects or denies your claim, they are still liable to pay for up to $10,000 of your medical costs.
The California Division of Workers’ Compensation (DWC) ensures injured workers receive all medical treatment necessary to cure or to relieve the effects of a workplace injury with no out of pocket expenses incurred by the employee. This includes:
- Hospital bills
- Doctor’s bills
- Medical equipment
- Prescriptions
You may also be entitled up to 24 chiropractic sessions and 24 physical therapy sessions.
Wage loss (“temporary disability” payments)
You will be paid two-thirds of your average weekly wages while you are “temporarily disabled” and unable to work. Overtime income and income from secondary employment can also be included.
Transportation
The insurance company will likely approve and arrange transportation for you. If you do incur any expenses for transportation, you may be able to receive compensation.
Permanent disability
Permanent disability payments are usually less than temporary disability payments. How much you receive will depend on your injury and the percentage of permanent disability determined by your doctor.
Supplemental Job Displacement Benefits
You may be eligible for supplemental job displacement benefits if:
- Your employer does not offer modified/alternative work
- You do not return to work within 60 days of no longer receiving temporary disability
